Terms and Conditions

§ 1 Scope
These General Terms and Conditions apply to all orders placed by consumers via the FabiVintage online shop (fabivintage.de).

§ 2 Contracting party, conclusion of contract
The purchase contract is concluded with Fabian Blank, FabiVintage, Peter-Dörfler-Weg 5A, 86637 Wertingen, Germany. The presentation of items in the shop does not constitute a binding offer. By submitting your order, you make a binding offer to purchase. We confirm receipt of your order by email; this order confirmation does not yet constitute acceptance of your offer. The purchase contract is only concluded with our shipping confirmation or the delivery of the goods. As all items are one-of-a-kind pieces, it may happen that an item has already been sold. In this case, we will inform you without delay and refund any payments already made.

§ 3 One-of-a-kind pieces and condition
FabiVintage sells used vintage clothing. Each item is a one-of-a-kind piece and is inspected before sale. The condition of each item, including any signs of wear or defects, is stated in the item description and shown in the photos. The condition ratings used mean: NM = very good condition with barely noticeable signs of wear, VG = good condition with light signs of wear, G = fair condition with clearly visible signs of wear. The specific description of the individual item is always decisive. The photos show the actual item offered.

§ 4 Prices and shipping costs
All prices are final prices. Pursuant to Section 19 of the German VAT Act (UStG), no VAT is charged and therefore none is shown. The prices stated at the time of the order apply. Shipping within Germany is free for orders of €100 or more. Below that amount, and for deliveries abroad, a flat shipping rate is charged, which is shown during the ordering process before the order is completed. For deliveries to countries outside the EU, additional customs duties, taxes or fees may apply, which you bear as the recipient.

§ 5 Payment
Payment is made using the payment methods offered at checkout (e.g. credit card, PayPal, Klarna, Apple Pay). The purchase price is due upon conclusion of the contract.

§ 6 Delivery
Delivery is made to the delivery address you provide. Processing time is usually 1 to 2 business days. Delivery time depends on the destination country (see the “Shipping” page).

§ 7 Retention of title
The goods remain our property until payment has been made in full.

§ 8 Right of withdrawal
As a consumer, you have a statutory right of withdrawal. Details can be found in the withdrawal instructions below.

§ 9 Warranty
The statutory warranty rights apply.

§ 10 Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected. Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.

Withdrawal instructions

Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods. If you order multiple goods in one order and they are delivered separately, the period begins on the day on which you, or a third party indicated by you, acquire physical possession of the last good.

To exercise your right of withdrawal, you must inform us

of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but this is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
