Terms and Conditions
§1 Scope
These General Terms and Conditions apply to all orders placed by consumers through the FabiVintage online shop (fabivintage.de).
§2 Contracting Party, Conclusion of Contract
The purchase contract is concluded with Fabian Blank, Peter-Dörfler-Weg 5A, 86637 Wertingen, Germany. By submitting your order, you make a binding offer to purchase. We confirm receipt of your order by email; this order confirmation does not yet constitute acceptance of your offer. The purchase contract is only concluded upon our shipping confirmation or actual delivery.
§3 One-of-a-Kind Items & Condition
FabiVintage sells used vintage clothing. Each item is a one-of-a-kind piece and is inspected before sale and given a condition rating (NM = near mint, VG = very good, G = good). Minor signs of wear that are consistent with the age and character of the material and that are visible in the product description or photos do not constitute a material defect.
§4 Prices and Shipping Costs
All prices include the applicable statutory VAT (or are exempt from VAT pursuant to §19 of the German VAT Act (UStG), if the small business regulation applies). The prices stated at the time of order apply. Within Germany, shipping is free for orders over €100; below that, a flat shipping fee applies, which is shown during checkout.
§5 Payment
Payment is made using the payment methods offered at checkout (e.g. credit card, PayPal, Klarna, Apple Pay). The purchase price is due upon conclusion of the contract.
§6 Delivery
Delivery is made to the shipping address you provide. Processing time is generally 24 hours; delivery time depends on the destination country (see Shipping Policy).
§7 Retention of Title
The goods remain the property of FabiVintage until paid in full.
§8 Right of Withdrawal
The statutory right of withdrawal applies (see Withdrawal Rights).
§9 Warranty
Statutory warranty rights apply. As these are used goods, any obvious signs of wear are specifically noted in the product description.
§10 Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
§11 Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
